Court rejects Claudine, Raymart's bid for writ of amparo vs Tulfo brothers

MANILA, Philippines - A Quezon City court has dismissed the bid of Raymart Santiago and Claudine Barretto for a writ of amparo against the Tulfo brothers who came to the defense of their sibling Ramon on their T3 show last May.
Judge Maria Filomena Singh of Regional Trial Court Branch 219 junked the couple's petition seeking government protection against brothers Erwin, Ben, and Raffy Tulfo.
Singh dismissed the petition in an eight-page resolution, which in effect dissolved a temporary protection court issued by the court in favor of the couple.
The court sustained the argument of defense lawyer Nelson Borja, who pointed out that the couple are not entitled to government protection under the writ of amparo as they are not victims of human rights violations.
Santiago and his wife Barretto earlier asked the court to grant them a writ of amparo against the T3 hosts for their alleged threats on their show, aired over TV5 last May 7.
The Tulfo brothers came to the defense of their brother Ramon, following the latter's brawl with the showbiz couple at the Ninoy Aquino International Airport.
The couple claimed that the writ of amparo is available to those whose right to life, liberty, and security is violated or threatened.
In May, then Branch 219 Presiding Judge Bayani Vargas issued a TPO barring the T3 hosts from getting within 500 meters of the Santiagos.
Borja, representing Erwin, noted that the writ of amparo refers to human rights abuses committed by the police and military.
The court sustained this argument, adding that the writ of amparo was originally intended as a response to cases of extrajudicial killings and enforced disappearances.
