MANILA, Philippines - The counsel of broadcaster Erwin Tulfo on Monday questioned the propriety of the petition for a writ of amparo filed by celebrity couple Claudine Barretto and Raymart Santiago against the Tulfo brothers.
Lawyer Nelson Borja said "the coverage of writ of amparo pertains only to (cases) of extra-judicial killings."
The couple had filed a petition for writ of amparo against "T3" hosts Raffy, Ben and Erwin Tulfo in which they also appealed for a temporary protection order against the brothers.
The couple was referring to an episode of the TV program of the brothers, in which the latter allegedly threatened them following an airport brawl the couple got involved in with columnist Ramon Tulfo
The couple had asked for a TPO barring the Tulfos from approaching them within 500 meters. This is aside from the police escorts from the Police Security Protection Office that the couple asked the court to assign to them.
The couple's lawyer, Alex Avisado, countered Borja's argument, citing an instance wherein former National Bureau of Investigation director Magtanggol Gatdula was granted a temporary protection order.
On cross-examination by Borja, the actress claimed hearing the brothers supposedly threatening them in their TV program: "Until sinabi nila na ipagtitirik nila kami ng kandila. Hindi ho ba mamamatay tao lang ang nagsasabi nun?"
Borja also argued the couple had already filed a criminal case in connection with the same incident.
"Once a criminal case has already been filed, you can't avail of the writ of amparo," Borja told reporters on the sidelines of yesterday's hearing.
But during the hearing, Avisado noted that the complaint for grave threats and oral defamation they filed was still at the prosecutor level and that no criminal information has been filed yet before any court.
Borja also questioned the need for a temporary protection order, noting that a policeman had already been assigned to the couple.
He also cited the actress' testimony that the couple has four private security guards, apart from their subdivision's security personnel.
But the actress replied: "Sir, marami hong bodyguards ang mga Tulfo."
Borja also pointed to an apology issued by Erwin on TV, but the actress said the broadcaster was apologizing to the public and not to them.
